About DUPHIX

These Terms apply to use of DUPHIX, a passive safety application operated by VDAST CO., LTD. DUPHIX is planned for Android and iOS; Android is the currently implemented platform and some behavior may differ by platform. The service is targeting December 2026, which is a plan and not a guaranteed release date.

By using DUPHIX, to the extent applicable, you agree to these Terms. If you do not agree, do not use the service. These Terms describe the current product design and may be updated as the service develops.

Eligibility and acceptance

You may use DUPHIX only where you are legally able to agree to these Terms and use the service. If you use DUPHIX for another person or in a shared safety arrangement, you are responsible for making sure that use is authorized and that the relevant people understand how the service works.

These Terms do not remove rights or protections that apply to you under applicable law.

How DUPHIX works

You configure safety schedules and activity windows. DUPHIX performs scheduled checks and compares permitted activity information with a prior reading. When activity has changed, the check proceeds normally. When no change is detected, the warning sequence begins and gives the user an opportunity to confirm that they are safe.

If the warning sequence finishes without a response, DUPHIX creates an automatic SOS alert for the selected recipients. The details and timing of a check can depend on the device, operating system, permissions, connectivity, and other service conditions.

No manual emergency button

DUPHIX does not depend on a manual SOS button. SOS escalation is driven by the scheduled passive-safety flow described above. Do not assume that you can manually trigger DUPHIX as a substitute for contacting emergency services.

Not an emergency service or medical device

DUPHIX is not a public emergency service, emergency dispatch center, medical device, medical monitoring service, or guaranteed rescue service. It does not guarantee detection of every emergency, delivery of every notification, receipt or review of an alert by a selected contact, a response by a selected contact, rescue, medical assistance, or police, fire, or ambulance response.

When you can do so, contact the appropriate local emergency services directly. DUPHIX does not replace emergency services, professional medical advice, or personal safety planning.

User responsibilities

  • Configure schedules and activity windows in a way that matches your intended use.
  • Select appropriate recipients and keep their App-ID configuration current.
  • Keep your device functional and maintain notifications and permissions needed for enabled features.
  • Maintain connectivity where the feature requires communication with DUPHIX systems or push infrastructure.
  • Use the service consistently with applicable law and respect the people whose App IDs you add as recipients.
  • Understand that operating-system restrictions, battery state, device settings, and network conditions can affect background operation and notification delivery.

You are responsible for deciding whether DUPHIX is suitable for your circumstances. No user responsibility can guarantee that the service will detect or deliver every event.

Device, permissions, and connectivity

DUPHIX operation can depend on a compatible device, operating-system behavior, permissions, background execution rules, battery or power state, Internet connectivity, and push notification infrastructure. You must grant the permissions needed for features you enable, including notifications and activity-related access where requested.

DUPHIX cannot override Android or iOS restrictions and does not promise exact background timing or universal compatibility across every device, operating-system version, or manufacturer configuration.

SOS alerts and selected contacts

You choose the recipients for an automatic SOS flow. Selected contacts are independent third parties. VDAST does not control whether a recipient’s device is available, whether the recipient sees an alert, or whether the recipient responds. Successful processing by DUPHIX or a push provider does not guarantee a human response.

You are responsible for choosing appropriate recipients and keeping the recipient configuration current. The current product uses push notifications for SOS delivery; it does not use SMS or Twilio delivery.

Advertising

DUPHIX may display advertising on ordinary application surfaces to help support operation of the service. Ad formats and availability may change over time, and third-party advertising providers may have their own terms and privacy policies.

Advertising is not a paid protection tier. Advertising must not intentionally delay safety confirmation logic, SOS handling, or presentation of an incoming recipient SOS alert.

Service availability and changes

DUPHIX may be affected by maintenance, infrastructure failures, Internet outages, push-provider outages, operating-system restrictions, device state, third-party services, or events outside reasonable control. VDAST does not promise 100% uptime, guaranteed timing, guaranteed notification delivery, or universal device compatibility.

VDAST may update, replace, limit, or discontinue features and may stop offering DUPHIX on a platform or in a market. Where practicable, VDAST may provide notice of material changes, but advance notice may not be possible in every situation.

Acceptable use

You must not use DUPHIX to:

  • break the law or deliberately create false or malicious SOS traffic;
  • attempt unauthorized access to the service, another installation, or another person’s recipient information;
  • disrupt service infrastructure or interfere with another person’s use;
  • impersonate a user or recipient, or use DUPHIX to harass or threaten someone; or
  • reverse engineer, copy, or modify the service except to the extent a restriction is not permitted by applicable law.

Intellectual property

DUPHIX software, branding, website content, and related materials are owned by VDAST CO., LTD or applicable licensors. Subject to these Terms, VDAST grants you a limited right to use the service for its intended purpose. This does not transfer ownership of the service or its materials.

These Terms do not claim ownership over information you enter into the application or data that belongs to you or another person.

Third-party services

DUPHIX may depend on third-party platforms and providers, including mobile operating systems, push notification infrastructure, advertising providers, and hosting or network infrastructure. Their availability, terms, privacy practices, and technical behavior may affect the service. They are not emergency services or agents of emergency responders merely because DUPHIX uses their infrastructure.

Disclaimer of warranties

To the extent permitted by applicable law, DUPHIX is provided on an “as available” basis. Technical operation may be affected by factors outside VDAST’s control, including device state, operating-system behavior, connectivity, push delivery, maintenance, and third-party services. VDAST does not promise that the service will be uninterrupted, error-free, or suitable for every situation.

Nothing in these Terms excludes or limits rights or liabilities that cannot be excluded or limited under applicable law.

Limitation of liability

To the extent permitted by applicable law, VDAST will not be responsible for losses arising from factors outside its reasonable control, a user’s device or configuration, unavailable connectivity, missed or delayed notifications, a recipient’s actions or inaction, or reliance on DUPHIX as an emergency or medical service.

This section applies only to the extent permitted by applicable law. It does not attempt to exclude or limit liability or rights that applicable law does not permit to be excluded or limited, and it does not create a monetary liability cap.

Suspension or discontinuation

The current product has no user-account suspension system. VDAST may restrict abusive access where technically available, perform maintenance, change or discontinue service components, or stop offering DUPHIX on a platform or in a market. VDAST may act without advance notice when reasonably necessary for security, abuse prevention, infrastructure protection, or other urgent operational reasons.

Changes to these Terms

VDAST may update these Terms when the product, platforms, service providers, or operating model changes. The “Last updated” date identifies the latest published version. Material changes should be communicated in a manner appropriate to the service and the affected users.

Governing framework

These Terms are governed and interpreted subject to applicable law. Nothing in these Terms removes mandatory rights or protections that apply to a user under applicable law. These Terms do not select an exclusive court, arbitration process, or forum waiver.
